About HBFI

The website at http://www.hbfi.ie (the “Site”) is owned and operated by Home Building Finance Ireland (“we”, “us” and/or “HBFI”). HBFI is incorporated pursuant to the Home Building Finance Ireland Act 2018.

HBFI is a single member designated activity company limited by shares incorporated and registered in Ireland (registered numbed 639272) whose registered office is located at Treasury Building, Grand Canal Street Lower, Dublin 2, D02 XN96. Your Use of the Site

By accessing or using the Site (including submitting an expression of interest via the Site), you acknowledge and agree to these terms and conditions and to any policies referred to in these terms and conditions, including our Data Protection Statement and our Cookies Notice. Please ensure that you read these terms and conditions carefully. If you do not agree to these terms and conditions, then do not use this Site or submit an expression of interest.

The Site is provided from Ireland for all eligible and interested corporate entities applying for finance from HBFI for the purposes of developing residential housing schemes in Ireland. This Site is aimed at businesses and by using this Site you are agreeing that you are acting in the course of business and not as a consumer. This Site is not for consumers and you may not submit an expression of interest if you are a consumer.

Eligibility Criteria

The eligibility criteria set out on the Site are indicative only and are subject to change. HBFI will assess each expression of interest that meets the eligibility criteria and any subsequent loan application in good faith and on its own merits and any agreement for finance entered into will be subject to separate terms and conditions. Confirmation of eligibility does not guarantee credit approval.

Expression of Interest

If you meet the eligibility criteria, you may submit an expression of interest to HBFI through the online form available on the Site. When you submit an expression of interest, you will receive an automated acknowledgment email from us containing your unique reference number. You must keep your unique reference number secure and confidential.

The submission of an expression of interest does not constitute a credit application under the Credit Reporting Act 2013. The acknowledgment email does not constitute an offer of finance, and does not create any legally binding relationship between HBFI and you. The expression of interest allows HBFI to determine whether your project meets HBFI’s eligibility criteria. HBFI may at its discretion invite you submit a complete credit application on foot of an expression of interest.

All applications for finance are made subject to further terms and conditions and are subject to contract and our acceptance. HBFI reserves the right to refuse any application for finance.

No Warranties or Reliance

While reasonable skill and care is used to ensure that the content of this Site is available, accurate and up to date, the Site is provided “as is” and HBFI makes no representations or warranties in relation to the availability, accuracy or completeness of the content on this Site. The content on the Site is provided for information purposes only and is subject to change and we reserve the right, at our sole discretion, to change, modify, add or remove portions of these terms and conditions at any time. You should check these terms and conditions periodically for changes. By using the Site, you accept any changes to the terms and conditions. Any changes to these terms and conditions will be deemed to be applicable from the first date of publication on the Site.

We do not warrant that the Site or any function contained on the Site will be uninterrupted or error-free or that defects will be corrected. We do not warrant that the servers that make this Site available, or the Site itself, will be error, virus or bug free and you accept that it is your responsibility to make adequate provision for protection against such threats. We recommend scanning any files before downloading them from the Site.

Nothing on this Site should be taken to constitute professional advice or a formal recommendation on which reliance should be placed and we exclude, to the greatest extent possible under applicable law, all representations and warranties, express or implied by statute, common law, equity, custom or otherwise (including those implied under the Sale of Goods and Supply of Services Act 1893 and the Sale of Goods and Supply of Services Act 1980) relating to the content and use of this site including any reliance on the information contained on the Site.

If you choose to access linked third party websites, you do so at your own risk and in accordance with the terms and conditions of such third party websites.

Exclusion and Limitation of Liability

In no event will HBFI be liable for any direct, indirect, consequential or special damages of any kind, including, without limitation, those resulting from loss of profit, loss of contracts, goodwill, data, information, income, anticipated savings, business relationships or other losses, whether or not advised of the possibility of such damage, arising out of or in connection with the use of, or inability to use, this Site.

To the extent that any loss suffered by you arising from your use of the Site cannot be excluded by applicable law, then the aggregate liability of HBFI for all such losses shall be limited to damages which shall not exceed five hundred euro (€500) in total.

By using this Site you agree to the exclusions and limitations of liability stated above and accept them as reasonable. Do not use this Site if you do not agree that they are reasonable.

Exceptions

Nothing in these terms and conditions excludes or limits any warranty implied by law for death, fraud, personal injury through negligence, or anything else which it would not be lawful for HBFI to exclude.

Acceptable Use of the Site

HBFI will not tolerate any use of the Site which damages or is likely to damage our reputation, the availability or integrity of the Site, or in a way which causes, or threatens to cause, any legal, tax, regulatory or any other liability. You must not use the Site for any illegal purpose, or in such a way as to infringe or breach the rights of others or to cause or threaten to cause us damage. We reserve the right to suspend the use of the Site generally or block your access to any part of the Site and/or to suspend or terminate your rights to use the Site or any part of it if we suspect misuse. We shall report any misuse of the Site to the relevant authorities. We further reserve the right to disclose any evidence we have which relates directly or indirectly to misuse of this Site.

Material on this Site, including text and images, is protected by copyright law and all such copyright is owned by HBFI unless credited otherwise. The content on this Site may not be copied, reproduced, republished, downloaded, posted, broadcast or transmitted in any way except for your own personal, non-commercial use.

Prior written consent of the copyright holder must be obtained for any other use of material.

No part of this Site may be distributed or copied for any commercial purpose or financial gain.

All intellectual property rights in relation to this Site are reserved and owned by NTMA, HBFI and / or the relevant HBFI group entities.

Law and Jurisdiction

These terms and conditions shall be interpreted and governed by Irish law, and any disputes in relation to it are subject to the exclusive jurisdiction of the courts in Ireland.

If any of these terms and conditions are found to be unenforceable under applicable law, that will have no bearing on the enforceability of the rest of these terms and conditions.
